Poultry projects are among the most sought-after agricultural investments, and among those most likely to draw environmental objections because of odors, manure, mortalities and occasional proximity to settlements. The environmental permit for a poultry farm therefore goes through two stages, construction then operation, with two main authorities involved. Poultry is also one of the activity types for which the Environmental Inspection and Audit Regulation calls for a dedicated inspection methodology. This article explains the full path from preliminary licensing to operation.

The competent authorities

  • Ministry of Environment, Water and Agriculture: the agricultural license for the project, biosecurity requirements and veterinary oversight. The Ministry pursues unlicensed poultry projects and applies the Agriculture Law to them.
  • National Center for Environmental Compliance (NCEC): the environmental construction and then operating permits under the Environmental Permits Regulation, and compliance inspections afterwards.

The preliminary stage: the construction permit

Before any construction on site (houses, roads, feed stores), the environmental construction permit is required. It starts with the classification form, and NCEC decides the category within 10 working days. The category determines what is required:

  • Category 1: an environmental management plan, and a rehabilitation plan for specified activities.
  • Category 2 or 3: an EIA study.

Project size (bird capacity) is a key classification factor. The Ministry of Environment had announced that poultry projects exceeding 300,000 birds per cycle must carry out an environmental impact study; check the threshold currently in force when applying. The construction permit is valid for three years, so do not obtain it before financing and execution are ready.

Location: the decision that is hard to change

Surrounding sensitive receptors and land use are classification criteria in the regulation. Proximity to homes, schools and water sources, or a location in wadi channels and water catchments, increases the impact and the likelihood of objections. An activity within, or 500 meters or less from, sensitive areas or receptors needs a detailed EIA. So assess the site's environmental suitability before buying or leasing the land, considering the prevailing wind relative to the nearest settlement.

The operating stage: the operating permit

After construction, the operating permit is required, valid for three to six years. The main operational topics are:

Waste under the Waste Management Law

The Waste Management Law prohibits leaving, burying, burning or dumping waste outside designated places, and requires producers to store waste in designated places and sort reusable materials. Manure can be a resource (fertilizer) if managed and transported lawfully, and the law puts reuse, recycling and resource recovery before disposal. Anyone handing waste to an unlicensed party is jointly liable for damages.

Soil and groundwater

Improper manure storage or carcass burial can pollute soil and groundwater. The soil regulation requires appropriate measures to prevent soil contamination and prohibits failing to notify NCEC immediately when contamination is detected. Dumping untreated liquid components into any environmental medium is among the violations heard by the competent court under the Penalties Regulation.

Expansion

Adding houses or increasing bird capacity changes the size of the activity and needs a new operating permit before it happens, and the increase may move the project into a higher category.
