But industrial land does not exempt a factory from environmental requirements: the factory environmental permit is tied to the factory's activity, not the land, it is a core part of the setup journey, and without it operation stops. The factory setup journey as described by official bodies

The industrial sector guide published on the Ministry of Investment website sets out the stages of establishing a factory in order:

  1. Obtaining a Ministry of Investment license (for foreign investors).
  2. Obtaining the commercial registration.
  3. Signing the land contract and obtaining the building permit for the industrial facility.
  4. Obtaining the final industrial license from the Ministry of Industry and Mineral Resources (Sinaei platform).
  5. Obtaining the environmental operating permit.

Environmentally, add the environmental construction permit before any construction on the land, because the Environmental Permits Regulation requires it before any construction works or modification of the activity. The regulation also requires environmental impact assessment to be considered in feasibility studies and preliminary designs.

What determines your factory's requirements?

The environmental category set by the National Center for Environmental Compliance (NCEC) after reviewing the classification form (within 10 working days), based on the type and size of industry, energy used, resource consumption, location and surroundings. A small filling plant differs from a chemical plant or a metal foundry. The category determines whether an environmental management plan is enough (Category 1) or an EIA study is required (Categories 2 and 3), and the published approval times are 15 days for Category 1, 40 for Category 2 and 85 for Category 3 according to the Saudi Business Center.

After operation: the factory's obligations

  • Permit conditions and the environmental management plan: monitored by NCEC throughout the activity.
  • Self-monitoring reports and records: waste, emissions, hazardous materials and discharges.
  • Stack measurements: the Air Quality Regulation requires annual measurements for stacks not under continuous monitoring through a licensed provider, initial measurements within 120 days of establishment or 40 days of reaching target production (whichever comes first), and records kept for at least five years.
  • Noise: 70 dB by day and 65 at night at the boundary in industrial areas under the Noise Regulation.
  • Industrial and hazardous waste: through carriers and facilities licensed by the National Center for Waste Management (MWAN), with a transport document for every shipment.
  • Environmental audit at renewal: for Category 2 and 3 factories every three years; NCEC decides within 30 days of receiving the study.
  • A new permit before any expansion, new production line or change of product.

  • Treating the environmental permit as a last step after installing equipment.
